Terms of Service

1. Placing an Order

Clients may place an order via the website by selecting the desired artwork size and number of subjects. The total cost includes the artwork price and a 6.2% sales tax.

  • Shipping for pieces smaller than 12x16 inches is covered by the artist. Larger works or expedited shipping costs are the responsibility of the client.

  • A 50% non-binding deposit is due at the time of ordering.

  • Clients will receive an email requesting three to four high-resolution reference photos (clear, well-lit, and not pixelated).

  • Upon review, the artist will send a rough sketch and may suggest changes to size or layout.

  • A final email with the agreed-upon sketch and timeline will follow. To confirm the order, the client must respond with “I agree” or “I accept.” Orders are not finalized until this confirmation is received. Delayed responses may affect the estimated completion date.

  • Turnaround ranges from four to six weeks, depending on the current workload and project scope.

2. Cancellation & Refund Policy

  • The 50% deposit is refundable only before the client confirms the order via email after reviewing the preliminary sketch.

  • Once the client responds with “I agree,” or “I accept,” the order becomes binding and non-refundable.

  • If unforeseen circumstances arise, clients are encouraged to contact the artist.

The artist reserves the right to cancel orders for any of the following reasons:

  • Personal emergencies (health, family, etc.): Full refunds will be issued, or the client may choose to receive the unfinished work or delay completion.

  • Rude or inappropriate behavior (e.g., excessive messaging, harassment, insults): In such cases, the deposit will not be refunded.

  • Inappropriate content: Orders featuring nudity, hate symbols, profanity, copyrighted work, or other sensitive material will be denied, and the deposit will be refunded with a written explanation.

3. Work Process & Revisions

  • Clients will receive progress updates, including a mid-point check-in.

  • At approximately 90% completion, a photo of the artwork will be provided.

  • Clients may request up to three minor changes, such as:

    • Adjustments to facial features for likeness

    • Background modifications

    • Clothing alterations

Important: Due to the physical nature of traditional artwork, major changes (e.g., repositioning limbs or faces) are not permitted, as they can compromise the integrity of the piece.

If additional changes are requested and approved by the artist, a fee of $50 per hour will apply.

4. Final Payment & Delivery

  • Upon completion, the client will receive a photo of the artwork and an invoice for the remaining 50% of the total price.

  • The artwork will only be shipped after full payment is received.

  • If the client fails to pay the balance within 30 days, the deposit and the artwork will be forfeited. Future purchase of the piece is at the artist’s discretion, and storage fees may apply.

  • Artwork will be shipped via USPS, packaged in a cellophane sleeve and cardboard box to ensure safe transit. A tracking number and final image will be provided.

  • The artist is not responsible for damage occurring after shipment due to improper handling.

5. Post-Sale Adjustments

Clients may request additional changes after receiving the artwork by emailing the artist with the subject line: “Post-Sale Adjustments.”

  • Adjustments are at the discretion of the artist.

  • All shipping fees and adjustment costs (starting at $50) are the client’s responsibility.

6. Copyright & Usage

  • Clients must ensure they have permission to use any copyrighted reference materials. The artist is not liable for any infringement.

  • The artist retains full copyright to all artwork.

  • Clients may not reproduce, sell, or use the artwork for commercial purposes without written permission.

  • Proper credit must be given when sharing the artwork online (e.g., tagging the artist’s page on social media).

  • The artist reserves the right to share both completed and in-progress artwork and reference materials for portfolio or marketing purposes unless otherwise agreed upon.

  • Reproductions of commissioned artwork will not be sold without the client’s permission
